This agreement is entered into between the subscriber (the subscriber, you or your) and The Winning Factor Horse Racing Pty Ltd (“TWF”), (TWF, we, us or our) owner of this website and app. By subscribing to TWF’s tips and betting instructions, the subscriber agrees to the following terms and conditions:

1. Use of Website and App - Each subscriber agrees to be bound by these terms. Your use of and access to the website and app indicates your acceptance of and agreement with these terms, as they exist at the time of use. 

2. Finality of All Subscriptions - The subscriber acknowledges that all subscriptions are final, and no refunds will be provided. The subscriber is responsible for ensuring they select the right subscription package. In the event of a dispute, TWF's decision shall be final.

3. Provision of Services - TWF provides detailed analysis, horse racing tips and outlines of betting instructions for products like Live Trader, Win Banker Bets, Value Long Shots, and the Trifecta. TWF provides these services at its sole and absolute discretion and may update information posted online without prior notice. The subscriber acknowledges that the information provided is collated and formed by us using our own mathematical calculation data and information gathered and developed solely by TWF.  TWF does not warrant the accuracy of this information and you should make your own enquiries and form your own opinions. 

4.  Proprietary Information and Obligations - The subscriber acknowledges that the information provided by TWF is solely for their use and subscription. The subscriber agrees not to share any information with third parties or to publish it without the express written consent of TWF. Furthermore, the subscriber acknowledges that they have read, understood, and accept TWF's Privacy Policy and agree to comply with all applicable privacy laws and regulations.

5.  Termination of Subscriptions - TWF reserves the right to terminate the subscription of any subscriber without notice or refund at any time if it suspects the subscriber has breached any term of the subscription agreement or fails to pay the subscription fees applicable to the service(s) the subscriber is a member of.

6. Access to Members Portal - The subscriber is issued with access to the members portal where proprietary information will be available. The subscriber agrees to keep their login details confidential and will not share them with any third party. The subscriber acknowledges that any unauthorised access to the portal is strictly prohibited.

7. Payments and Refund Policy - Payments made by subscribers are final and non-refundable. The subscriber agrees to pay all fees and charges associated with their subscription in a timely manner. In the event that a refund is applicable, which is at the discretion of TWF, the subscriber acknowledges that TWF will process the refund within 7 business days. 

8. Disclaimer of Liability and Indemnity - TWF does not guarantee the accuracy or validity of the information provided, nor provide any advice on how to bet or how much to bet. The subscriber acknowledges that they participate at their own risk. The subscriber will indemnify TWF from any claim for loss suffered as a result of using the subscription services. TWF does not accept any liability for any damages or loss suffered by the subscriber as a result of their use of TWF's services.

9. No Guarantee of Tipping Advice - TWF may or may not provide tipping advice for certain events or at all if it deems there are no satisfactory choices or events that suit the mathematical system deployed by TWF.

10. Waiver – No failure or delay by us in exercising any right under these terms and conditions will operate as a waiver of our rights. Similarly, any single or partial exercise of any right will not preclude any further exercise of any of these rights or the exercise of any other right.

11. Updated Terms and Agreement - Subscribers must accept new terms of an agreement for the services to continue. The subscriber warrants that they are 18 years of age or over and provides proof of age, including government identification. If we discover that you are under 18 years old and have used our website or app, your stake will be forfeited and we will not be obliged to pay you any winnings which might otherwise have been payable to you in respect of any bet you placed.

12. Racing Terminology - The subscriber acknowledges and accepts that they are responsible for familiarising themselves with the terminology used on the website and in TWF's services.

13. Social Media - The subscriber acknowledges that TWF has active social media channels and agrees not to post or publish any defamatory content related to TWF or its services. TWF has the right to take legal action against the subscriber for any defamatory posts made by the subscriber. 

14.  Intellectual Property – The subscriber acknowledges and agrees that all intellectual property including our website and app is owned by TWF, unless stated otherwise. Subject to these terms and conditions, you agree that you will not infringe TWF’s intellectual property as contained on TWF’s website and app, and will not modify, copy, republish, frame, distribute or communicate any part of TWF’s website, app or any information contained in it or otherwise use TWF’s website or app in a way which will infringe TWF’s intellectual property or other rights.

15. Obligation of TWF - TWF agrees to provide the subscriber with the most accurate, up-to-date horse racing tips and betting suggestions in line with mathematical calculations, data, and information. Additionally, TWF agrees to follow all applicable Australian privacy laws & 

regulations and produce a clear and concise privacy policy available on the website and app.

16. Obligations of the Subcriber- The subcriber agrees to be bound to the terms and conditions of this agreement and or any ammendments to the agreement supplied by TWF from time to time. The subcriber acknowledges it has been provided with this subcribers agreement, the companies privacy policy statement and a copy of the comipanies disclaimer. The confirm they have read each of the above documents and confirm they will comply with the terms and conditions as set out in those documents and this agreement.

17. New Memberships Marketing and Offerings- TWF will offer new mebership proposal to attack new members to TWF and it avaible products from time to time. As such these membership offerings may vary in price and may be sold at a discount to current memberships. Active members are not eligible to perticipate in those offerings unless they purchase a membership which is not similar or the same as the offering placed by TWF.

The subscriber acknowledges and accepts the terms and conditions outlined above while subscribing to TWF’s website and app. The subscriber agrees to maintain all obligations as outlined above while using TWF's services.
